Upton & Hatfield Law Firm Wins $5 Million Verdict for Client in Medical Malpractice Case

Medical Malpractice Verdict

On Thursday, November 25, 2012, a Rockingham County jury returned a $5 million dollar verdict in favor of Noel and Adam Jodoin in a medical negligence case against Dr. Ellen Johnson and Advanced Diagnostic Imaging.

Concord Attorneys Gary Richardson and Heather Burns, with the assistance of Attorney Lisa Hall represented the Jodoins. At the age of 25, Ms. Jodoin went to the Exeter Hospital emergency room complaining of a severe headache.  She underwent CT imaging of her brain that showed evidence of a stroke.

The evidence presented at trial showed that Dr. Ellen Johnson, a radiologist, issued a preliminary report stating the imaging was NEGATIVE.  Ms. Jodoin’s condition deteriorated requiring her to be emergently flown to a large Boston hospital, where the stroke was finally diagnosed.

The delay in diagnosing the stroke resulted in brain hemorrhage leaving Ms. Jodoin with permanent brain damage and disabilities.

The jury deliberated for just under three hours before returning a verdict assigning 100% of the fault to Radiologist, Dr. Ellen Johnson and her employer at the time, Advanced Diagnostic Imaging. Dr. Johnson is currently working in Massachusetts.
